Person County businessman charged with state tax offenses - 8/8/08

RALEIGH — A Person County businessman was arrested Thursday on felony tax charges filed by the North Carolina Department of Revenue.

Kenneth Todd Carver, 44, who resides in Clarksville, Va. and formerly operated Kelly W. Carver Masonry, Inc. in Person County, was charged with one count of embezzlement of state property and three counts of obtaining property by false pretense.

An arrest warrant alleges that Carver, as president and responsible corporate officer of Kelly W. Carver Masonry, aided and abetted the corporation to embezzle and knowingly misapply $62,082.21 in North Carolina withholding taxes from Jan. 1, 2003 through Dec. 31, 2006. Additional warrants allege that Carver knowingly filed fraudulent 2004, 2005 and 2006 North Carolina individual income tax returns claiming $12,406 in state withholding taxes that he knew he had not remitted to the Department of Revenue.

Kelly W. Carver Masonry has now ceased operations.

The charges against Carver resulted from an investigation by a special agent with the Department of Revenue’s Criminal Investigations Division in Raleigh.

Carver was held under a $75,000 secured bond Thursday following his arrest. He was scheduled to make his first appearance Friday in Wake County District Court.
